This page will provide you with information necessary to report to Flying Pig Ventures, LLC (“Flying Pig”) and request the removal of suspected infringing items and materials posted on the website at www.hometheaterinaboxreview.com (the “Site”).

Flying Pig may investigate a violation of its terms and conditions of use of the Site or its policies pursuant to a complaint, and may take any action that it deems appropriate. Such action may include, but is not limited to, issuing warnings, suspension or termination of service, and/or removal of posted content. Flying Pig reserves the right, and has absolute discretion, to remove, screen or edit any content that objectionable or otherwise inappropriate. Flying Pig also reserves the right to report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other third parties. Pursuant to the Digital Millennium Copyright Act, if you are the actual owner of intellectual property, you may provide the official notice of infringement below, and Flying Pig will act in accordance with the Digital Millennium Copyright Act in connection with such materials.

Although Flying Pig does not monitor the content placed on its site, it will not allow materials that it has actual knowledge to be infringing of a third party’s intellectual property rights. Such infringing materials will be removed from the Flying Pig Site, and repeat offenders will have their membership terminated.

To report a potential infringement of copyrighted works on Flying Pig’s web site pursuant to the Digital Millennium Copyright Act:

What is the DMCA?

Congress passed the Digital Millennium Copyright Act (DMCA) in October of 1998. The purpose of DMCA is two-fold: to limit the liability of service providers whose users are infringing upon the copyright of others, and to define the procedures necessary to report such infringement.

To report any material that you feel infringes any of your intellectual property rights, please print out, complete, sign and return a Notice of Infringement. Pursuant to the Digital Millennium Copyright Act, only owners of intellectual property may provide this official notice for intellectual property that they feel is being infringed.

Please be aware that you could be liable for damages (which could also include attorneys’ fees) if you misrepresent a claim that certain content is infringing upon your copyright.

If you are not absolutely certain whether material present on the Site infringes upon your copyright, for example, whether it is protected under exceptions to the copyright law like fair use, you should consult with an attorney prior to submitting a claim of copyright infringement.

What Happens Now?

Upon receipt of notification, Flying Pig will take steps to disable access to the infringing material. However, if the users posting the content in violation believe they are authorized to use the material, they are entitled to file a counter-notification with Flying Pig to that effect.

Following receipt of a counter-notification, the original notifier will be provided with a copy of the counter-notification. Access to the content will remain disabled. Unless the original notifier informs Flying Pig that an action has been filed seeking a court order to restrict access to the content, the content will be replaced after 14 business days.
